General Terms and Conditions (GTC)
As of: September 2026
§ 1 Scope & Contracting Parties
These General Terms and Conditions apply to all contracts for the rental of holiday apartments for accommodation concluded between the hosts Stefan & Martina Rückbrod (hereinafter 'Landlord') and the guest (hereinafter 'Tenant') for the holiday apartments 'Zwergenbau' and 'Zwergenwald'.
§ 2 Booking and Conclusion of Contract
By submitting the booking form on the website, the Tenant makes a binding offer to conclude an accommodation contract. The contract only becomes legally binding upon written confirmation (via email or WhatsApp) from the Landlord.
§ 3 Prices, Tourist Tax and Payment Terms
The agreed prices include statutory VAT and final cleaning. The local tourist tax of the municipality of Badenweiler is not included in the total price and will be invoiced separately on site.
Payment is standard practice made on-site in cash upon departure. Alternatively, a PayPal payment can be arranged shortly before arrival.
§ 4 Cancellation by the Tenant (Cancellation Policy)
Any cancellation of the contract by the Tenant must be made in writing (e.g., via email). In the event of a cancellation, the Landlord reserves the right to claim a portion of the agreed price as compensation. The following cancellation rates apply (unless otherwise agreed):
- Up to 14 days before the arrival date: Free cancellation. Guests receive a 100% refund of the amount paid.
- Less than 14 days before the arrival date or in case of non-arrival: No refund will be issued. The Landlord will charge a cancellation fee amounting to 90% of the total rental price (10% is deducted for saved operational expenses such as electricity, water, and final cleaning).
We recommend taking out travel cancellation insurance to protect yourself against unforeseen events.
§ 5 Cancellation and Termination by the Landlord
The Landlord may terminate the contract before or during the stay in the following exceptional cases:
- Force Majeure or Uninhabitability: If fulfillment of the contract is rendered impossible due to force majeure (e.g., natural disasters, strikes), official regulations, or unpredictable damage to the property (e.g., severe water damage, heating failure in winter), the Landlord may withdraw from the contract free of charge. Any payments already made will be refunded in full. Further claims for damages are excluded.
- Breach of Contract: The Landlord may terminate the contract without notice if the Tenant or fellow travelers persistently behave contrary to the contract despite receiving a warning. This includes, in particular, unauthorized occupancy of the apartment, willful damage to the inventory, or significant disturbance of the domestic peace (e.g., noise disturbance after 10:00 PM).
In the event of termination due to a breach of contract, the Landlord retains the right to claim the total rental price in accordance with the cancellation terms in § 4.
§ 6 Arrival and Departure (Check-In / Check-Out)
The holiday apartments are available from 4:00 PM on the day of arrival. On the day of departure, the apartments must be vacated in broom-clean condition by 11:00 AM at the latest. Dishes must be washed and put away, and trash must be sorted.
§ 7 Use, Damages and House Rules
The holiday apartments may only be occupied by the persons listed in the booking. Holding parties, celebrations, or any other kind of events in the apartments, on the balconies, or on the terraces is strictly prohibited.
A strict smoking ban applies within all indoor areas. Smoking is permitted exclusively on the balcony or terrace, provided that the provided ashtray is used.
In the interest of mutual consideration, general quiet hours must be respected. Night quiet hours apply from 10:00 PM to 6:00 AM. During this time, any loud noise must be avoided, and televisions and audio devices must be set to a low volume.
Bringing pets of any kind is not permitted in any of our holiday apartments.
The provided internet access (Wi-Fi) may only be used for private purposes during the stay. The Tenant is prohibited from using the Wi-Fi for unlawful activities. In particular, filesharing (e.g., illegal downloads of movies or music via peer-to-peer networks) is strictly forbidden. In the event of violations, the Tenant is fully liable and indemnifies the Landlord against all third-party claims (e.g., warning notices). The Wi-Fi password must not be passed on to unauthorized third parties.
The Tenant is liable for all damages caused to the holiday apartment and its inventory during their rental period by themselves or their companions. Damages must be reported to the Landlord immediately.
§ 8 Limitation of Liability of the Landlord
The Landlord is liable for the accuracy of the description of the holiday apartment and is obliged to provide the contractually agreed services properly.
The Landlord's liability for property damage and financial loss is limited to three times the rental price, provided that the damage to the guest was caused neither intentionally nor through gross negligence by the Landlord.
No liability is assumed for items brought into the holiday apartment by the guest (valuables, cash, clothing, etc.) in the event of theft, burglary, or damage by third parties. The guest is obliged to always keep windows and doors locked when leaving the apartment.
§ 9 Place of Jurisdiction & Severability Clause
Amendments or supplements to this contract must be made in writing. The place of performance and payment is the residence of the Landlord. The residence of the Landlord (Müllheim/Badenweiler) is agreed upon as the exclusive place of jurisdiction.
Should individual provisions of these General Terms and Conditions be or become ineffective or unenforceable, or become ineffective or unenforceable after the conclusion of the contract, the effectiveness of the remaining General Terms and Conditions shall remain unaffected.
